NO BAD FAITH CLAIM HANDLING OR DELAY IN UIM BAD FAITH CASE (C.C.P. Monroe)

The excellent, and important, TortTalk blog has posted a summary of Monroe County Judge Williamson’s decision in Sabajo v. Allstate, granting summary judgment to the insurer on a UIM bad faith claim. After reviewing the record, Judge Williamson could not find clear and convincing evidence of bad faith conduct in claim handling, or any delay that amounted to bad faith.
